Regulations on rights and obligations when accessing and using BMC online services
These Terms of Use (“Terms”) govern your access to and use of BMC Consult website, applications, and online services. Please read them carefully before using.
Acceptance of Terms
By accessing or using the website bmcconsult.vn, its subdomains, mobile applications, or any online services provided by BMC Consult Co., Ltd.(“BMC”, “We”, “Us”), you confirm that you:
- Have read, understood, and agreed to be bound by all of these Terms;
- Have read and agreed to BMC's Privacy Policy;
- Have full civil capacity in accordance with Vietnamese law;
- If representing an organization, you are legally authorized to accept these Terms.
If you do not agree with any content, please immediately stop using the Website.
Legal Basis: These Terms are formulated based on the Civil Code 2015, Commercial Law 2005, Law on Electronic Transactions 2023, Law on Cybersecurity 2018, Law on Intellectual Property, and Law on Protection of Consumers' Rights 2023.

User Account
3.1. Registration
To fully utilize the features, you must register an Account and provide accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your password and all activities occurring under your Account.
3.2. Account Security
- Do not share login credentials with third parties;
- Enable two-factor authentication (2FA) when supported;
- Notify BMC immediately via support@bmcconsult.vn upon detecting unauthorized access.
3.3. Account Suspension & Termination
BMC reserves the right to suspend or terminate Accounts without prior notice if the User violates the Terms, engages in fraudulent behavior, or causes damage to BMC, its partners, or other Users.
Regulations on Use
When using the Website, the User agrees to:
- Use the Website for proper, lawful purposes in compliance with Vietnamese law and these Terms;
- Do not interfere with or disrupt the normal operation of the Website;
- Do not copy or distribute BMC Content without prior written consent;
- Respect the rights and interests of other Users and third parties.

| Commercial | Using the Website for spam, unauthorized advertising, or unfair competition. |
| System | Reverse engineering or decompiling the source code; creating abnormal loads on servers. |
Sanctions: Any violations will result in Account termination, access blocking, reporting to competent authorities, and potential damage compensation in accordance with legal regulations.
Intellectual Property Rights
All BMC Content on the Website – including but not limited to: texts, images, videos, logos, trademarks, interfaces, source code, databases, and product packaging designs – is the lawful property of BMC Consult Co., Ltd. or is used by BMC under lawful authorization from third parties.
Users are permitted to:
- Access, view, and download BMC Content for personal, non-commercial use;
- Share links to public pages of the Website;
- Briefly quote (under 300 words) with clear source attribution 'According to BMC Consult – bmcconsult.vn'.
Users are not permitted to:
- Copy, reproduce, or redistribute in any commercial form;
- Use BMC logo or trademarks on your own products, packaging, or publications;
- Remove copyright or source information;
- Create derivative products without prior written authorization from BMC.
User-Uploaded Content
When Users post comments, reviews, images, or documents on the Website (hereinafter referred to as “User Content”), the User:
- Warrant that you are the lawful owner with full rights to share such content;
- Grant BMC a non-exclusive, royalty-free, worldwide, perpetual license to store, display, technically edit, and promote such content on BMC's platforms;
- Assume all legal responsibilities for the uploaded content.
BMC reserves the right – but is not obligated – to review, edit, or remove User Content that violates the Terms, legal regulations, or damages BMC's reputation.
Transactions & Payments
For transactions involving buying products or ordering services through the Website, the User agrees to:
- Provide accurate payment information; assume responsibility for the legitimacy of the funds;
- Comply with the ordering and confirmation procedures announced by BMC;
- Pay in full according to the listed price (including VAT if applicable).
BMC reserves the right to refuse orders in case of: incorrect information, suspected fraud, out-of-stock products, or price display errors on the Website. In such events, any paid amount (if applicable) will be fully refunded within 07 working days.
Warranty & Returns
The warranty, return, and refund policies for each product/service line are published separately on respective product/service pages and constitute an integral part of these Terms. Users are advised to read them carefully before ordering.
Third-Party Links
The Website may contain links to third-party websites (e.g., social networks, payment gateways, logistics partners). BMC is not responsible for the contents, privacy policies, or practices of these websites. Users assume their own risk when accessing them and should read the respective terms of each third party.
Disclaimers
The Website and Services are provided on an “as is” and “as available” basis. Although BMC endeavors to ensure accurate information and a stable system, we do not warrant that:
- The Website will operate continuously, uninterrupted, and error-free;
- All information, especially regarding agricultural, veterinary, or investment advice, is absolutely accurate and suitable for each User's specific circumstances;
- The Website is completely free of viruses or harmful components;
- The results of using products or services will meet the User's expectations.
Important Note: Information and advisory content on the Website is for reference only and does not replace direct professional consultation. For investment decisions, Users should consult independent financial experts and assume full responsibility for their decisions.
Limitation of Liability
To the maximum extent permitted by law, BMC and its affiliates (directors, officers, employees, partners) shall not be liable for any indirect, incidental, special, or consequential damages arising from the User's use or inability to use the Website – even if advised in advance of the possibility of such damages.
Indemnification
The User agrees to indemnify, defend, and hold harmless BMC, its affiliates, directors, officers, employees, and partners from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising out of:
- User's violation of these Terms or legal regulations;
- User Content infringing on third-party rights;
- Usage of the User's Account (whether authorized or not).
Termination of Use
BMC reserves the right to terminate or restrict the User's access to the Website at any time, for any reason, including but not limited to violations of the Terms. Such termination shall not affect obligations arising prior to the termination.
Terms regarding Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution shall survive termination.
Applicable Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.
- Any disputes arising shall first be resolved through good-faith negotiation within 30 days from the date either party sends written notice;
- If no agreement is reached, the dispute shall be referred to the Vietnam International Arbitration Centre (VIAC) in Ho Chi Minh City, resolved in accordance with its Arbitration Rules, in the Vietnamese language, by one (01) arbitrator;
- The arbitral award shall be final and binding on both parties.
For disputes with consumers involving small values, the parties may opt for the competent People's Court in accordance with the Law on Protection of Consumers' Rights 2023.
Changes to Terms
BMC may modify these Terms from time to time. The updated version will be published on the Website with its effective date. For material changes, BMC will send email notifications and display banners on the Website at least 15 days before they take effect.
Your continued use of the Website after the modified Terms take effect constitutes acceptance of those changes. If you do not agree, please stop using the Website and request Account deletion.
